ResumeCoach Terms of Use

1. Eligibility and Access

1.1 Geographic Eligibility

The Service is available exclusively to users located in the European Union (EU), the European Economic Area (EEA), and the United Kingdom. By using the Service, you confirm that you are in one of these eligible regions. We reserve the right to verify your location and to suspend or terminate accounts accessing the Service from outside these areas. Services accessed in violation of this geographic restriction may be terminated without refund.

1.2 Age Requirement

You must be at least 16 years old to create an account and use the Service. By using the Service, you represent that you meet this age requirement and are legally capable of entering into a binding contract.

2. User Accounts

To access certain features, you must create a user account with a valid email address and a secure password. You are responsible for maintaining the confidentiality of your login credentials and all activities that occur under your account. You agree to provide accurate information and to update your account as needed. You must not share your account with others or allow any unauthorized access; you are liable for all use of the Service under your account.

3. Description of Services

ResumeCoach is a software-as-a-service (SaaS) platform that provides AI-powered career document tools, including but not limited to:

• Resume Analysis: Automated analysis of resume content using artificial intelligence to provide ATS (Applicant Tracking System) compatibility scores and improvement recommendations.
• Resume Tailoring: Tools to customize your resume for specific job descriptions using AI-generated content suggestions.
• Cover Letter Generation: Automated creation of cover letters based on user-provided information and job requirements.
• Document Management: Cloud-based storage and management of your career documents and AI-generated outputs.

These services are delivered via AI algorithms (including OpenAI's GPT models) that process the information you provide and generate recommendations or content in response to your requests. Service output is delivered to you through your account dashboard in real time.

4. Token System and Payment Terms

4.1 Token Credits – Nature and Use

Our Service operates on a credit system using "tokens" as the unit for consuming services. Tokens are software credits, not currency or electronic money. Tokens have no cash value and are solely a means to access specific features of our Service. Tokens cannot be exchanged for cash, transferred to other users, used outside of ResumeCoach, or redeemed for any goods or services except our own Service features.

4.2 Purchasing Tokens – Pricing and VAT

Tokens are purchased in fiat currency (e.g. Euros or British Pounds). All token prices displayed include any applicable VAT (Value Added Tax) in accordance with EU/UK tax laws. Tokens may be sold in predefined packages (e.g., bundles of tokens) through our payment processor. The price you pay at checkout is inclusive of VAT; a breakdown may be provided on your receipt for your records.

4.3 Payment Processing

All payments are processed securely via Stripe, our third-party payment processor. By purchasing tokens, you authorize us to charge your provided payment method for the selected amount. We do not store your credit card details; payment handling is subject to Stripe's terms and privacy policy. Payments are accepted in Euros (€) and/or GBP (£), and your bank or card provider may convert currencies or charge additional fees if applicable (you are responsible for any such fees).

4.4 Token Allocation and Service Fees

Purchased tokens are credited to your user account. Each time you use a service feature, the corresponding token amount is deducted from your balance. The current token costs for each service request are:

• Resume Analysis – 30 tokens per analysis
• Resume Tailoring (job-specific adaptation) – 40 tokens per tailored resume
• Cover Letter Generation – 12 tokens per cover letter

The token deduction occurs at the time the service is delivered. We may, at our discretion, offer a one-time free trial or bonus – for example, your first resume analysis may be free of charge as a trial (any such promotions will be clearly communicated and subject to these Terms).

4.5 Token Validity

Tokens do not expire and will remain valid and available in your account for as long as your account is active. Pre-paid tokens are stored as a balance under your account and will be applied automatically to service requests until exhausted.

4.6 Pricing Changes

We reserve the right to adjust token pricing or service token costs. If pricing changes, we will provide at least 30 days' notice to existing users (for example, via email or a notice on the website) before new pricing takes effect. Continued use of the Service after price changes constitute acceptance of the new prices. If you do not agree with a price change, you may stop purchasing new tokens or discontinue use of the Service.

4.7 Refunds and Cancellation – Consumer Rights

Purchases of tokens are non-refundable once the tokens have been supplied to your account, except as required by applicable consumer protection laws. This means that, in general, we do not offer refunds for unused tokens. However, if you are an EU/EEA/UK consumer, you may have a legal right to withdraw from a purchase contract within 14 days of purchase.

By purchasing tokens and immediately using the Service, you expressly request and consent that we begin providing the digital service right away, and you acknowledge that you thereby waive your 14-day right of withdrawal to the maximum extent permitted by law. In plain terms, if you start using our Service (for example, by consuming tokens for a resume analysis) before the 14-day period ends, you lose the right to cancel that purchase.

If you purchase tokens and do not use any of them, you may exercise your right of withdrawal within 14 days of purchase by contacting us to request a cancellation and refund of the unused tokens. Any refunds granted will be issued to the original payment method when possible. This does not affect any other statutory rights you may have.

5. Delivery of Services

Upon successful purchase of tokens and submission of a service request (such as requesting a resume analysis or cover letter), the Service will be performed and delivered immediately via your account. You will receive the AI-generated analysis or document on-screen and/or via download within the ResumeCoach platform. Because services are delivered digitally and on-demand, you understand that delivery is instant once a request is made and corresponding tokens are deducted.

We strive for prompt delivery; however, factors such as system load or network issues could cause brief delays. If you encounter any technical issues accessing your results, please contact customer support for assistance.

6. User Content and License to ResumeCoach

6.1 Your Content

You retain all rights and ownership over the content you provide to the Service, such as your uploaded resumes, CVs, cover letters, job descriptions, personal information, and any other data you input. We do not claim ownership of your original materials.

6.2 License to Us

By uploading or inputting content, you grant PG Gaming Ltd. (ResumeCoach) a limited, non-exclusive, royalty-free license to use, process, reproduce, and analyze your content solely for the purpose of delivering the Service to you. This license allows us to feed your data into our AI algorithms, generate feedback and documents, and otherwise provide our features. We will not use your content for any unrelated purposes without your consent.

6.3 AI-Generated Outputs

The resumes, cover letters, analyses, recommendations, or other materials generated by our AI in response to your requests are provided for your personal use. You are granted a license to use, download, modify, and distribute the AI-generated content that we deliver to you for your own job-seeking and professional purposes. However, the underlying software, algorithms, models, and methodologies that produce those outputs remain our intellectual property. This means you may use the results, but you have no ownership in the AI system or its code.

6.4 Privacy

We handle personal data you provide in accordance with our Privacy Policy and applicable data protection laws. By using the Service, you acknowledge that your data will be processed by our AI and stored on our servers as necessary to fulfill the Service.

7. Acceptable Use and Prohibited Activities

You agree to use ResumeCoach only for its intended purpose and in compliance with these Terms and applicable laws. You may not:

• Use the Service for any unlawful purpose, or in violation of any laws or regulations.
• Submit any information or content that is false, misleading, defamatory, fraudulent, or infringing on others' rights.
• Attempt to reverse engineer, decompile, copy, or extract the source code, algorithms, or data of our software or AI models.
• Share your account or login credentials with anyone else, or allow unauthorized access to the Service through your account.
• Use any automated system (bots, spiders, scrapers) to access, query, or otherwise collect information from the Service without our prior written permission.
• Interfere with or disrupt the proper functioning of the Service or the servers and networks connected to the Service.
• Upload or use the Service to generate any content that is offensive, unlawful, or that violates the rights of any third party (including intellectual property and privacy rights).

Violation of the above rules may result in immediate suspension or termination of your account, and may also subject you to legal consequences.

8. Intellectual Property and License to Use Service

All rights, title, and interest in and to the Service (including its design, software code, algorithms, architecture, features, and underlying technology) are owned by PG Gaming Ltd. and are protected by UK and international intellectual property laws. "ResumeCoach" and associated logos and trademarks are our property (or licensed to us) and may not be used by you without our prior written consent.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial job-seeking purposes. You may not, except as explicitly permitted by us, copy, modify, distribute, sell, sublicense, or lease any part of our Service or included software. You also may not reverse engineer or attempt to extract the source code of our software, unless laws prohibit those restrictions or you have our written permission.

If you provide feedback or suggestions regarding the Service, we may use such feedback without obligation to you.

9. AI Content Disclaimers and No Guarantee

Our Service uses advanced artificial intelligence (including models provided by OpenAI) to generate resume feedback, tailored content, and recommendations. While we strive for accuracy and usefulness, you acknowledge and agree to the following disclaimers:

• AI Limitations: AI-generated content may contain errors or inaccuracies. The suggestions and text provided might occasionally be irrelevant or inappropriate. You are solely responsible for reviewing and verifying all content produced by the AI before using it in any professional capacity.
• No Guaranteed Results: ResumeCoach provides guidance and recommendations to improve your job application materials, but we do not guarantee any specific outcome such as getting a job interview, receiving job offers, or obtaining employment. Success in job applications depends on many factors beyond our Service.
• Not Professional Career Advice: The Service's outputs should be used as helpful tools and not as a substitute for professional career counseling or personalized advice. We are not a recruitment agency or career coaching firm. Always use your judgment when applying our suggestions to your situation.
• User Responsibility: You remain responsible for the content of your resume and cover letters. Use of any AI-provided text is at your discretion and risk. We are not liable for consequences of applying AI-generated content, such as negative feedback from employers or missed opportunities.
• No Academic or Cheating Use: You should not use the Service to generate content for academic submissions or any purpose that violates ethical or legal standards.

By using the Service, you acknowledge these limitations. Always review and edit the outputs to ensure accuracy and appropriateness for your needs.

10. Limitation of Liability

The Service is provided on an "as is" and "as available" basis, without warranties of any kind (either express or implied) to the fullest extent permitted by law. This means we do not guarantee that the Service will be error-free, uninterrupted, or meet your expectations. Specifically, we disclaim any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, PG Gaming Ltd. (ResumeCoach) will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of (or inability to use) the Service. This includes, without limitation, any loss of profit, loss of data, loss of employment opportunities, or business interruptions, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for all claims arising out of or relating to the Service is limited to the total amount you have paid to us for tokens or services in the 12 months immediately preceding the event giving rise to the liability. If you have not paid anything (for example, if you only used free services), we have no liability to you except as otherwise required by law.

Consumer Rights: Nothing in these Terms is intended to exclude or limit any statutory rights that apply to you. For example, if you are a consumer in the EU, you may have non-excludable rights regarding defective digital content or services. These Terms do not affect rights which cannot be waived under law. In particular, we do not exclude or limit our liability for death or personal injury caused by our negligence, or for our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

11. Data Protection and Privacy

We are committed to protecting your personal data. PG Gaming Ltd. complies with the EU General Data Protection Regulation (GDPR), the UK Data Protection Act 2018, and other applicable data protection laws. We collect and process personal information in accordance with our Privacy Policy (available on our website), which is hereby incorporated by reference. The Privacy Policy explains what data we collect, how we use it, and the rights you have regarding your data.

By using the Service, you consent to the collection and use of your data as outlined in the Privacy Policy. Key points:

• We use your data to provide and improve the Service (e.g. using your resume content to generate feedback).
• We share data with third-party processors only as needed (for example, sending your text to OpenAI's API for analysis, processing payments and storing data on our cloud database).
• We implement appropriate security measures to safeguard your information.
• You have rights to access, correct, or delete your data, as well as other rights under GDPR (see Privacy Policy for details).

If you decide to delete your account, we will delete or anonymize your personal data, except for information we are required to retain by law or for legitimate business purposes (for example, records of transactions for financial reporting or fraud prevention). Generally, basic transactional records may be retained for a period (e.g. 5 years) as required under tax or accounting laws, after which they will be securely erased.

12. Third-Party Services and Integrations

ResumeCoach integrates with certain third-party services to function effectively. Notably:

• OpenAI: for AI content generation and analysis (use of OpenAI's API is subject to OpenAI's terms and privacy policy).
• Supabase: for data storage and user authentication (subject to Supabase's terms and privacy policy).
• Stripe: for payment processing (subject to Stripe's terms and privacy policy).

While we have selected reputable providers and put safeguards in place, we do not control these third parties. Therefore, we are not responsible for the acts or omissions of third-party services, or their compliance with law. Your use of those services via our platform is subject to each provider's terms. We encourage you to review the privacy policies of OpenAI or any other third-party we integrate, to understand how they handle your data.

If any third-party service becomes unavailable or we change providers, we will strive to minimize impact on the Service and notify users of significant changes when appropriate.

13. Service Availability and Changes

We aim to provide a reliable and high-quality service, but we do not guarantee that the Service will be available 100% of the time or error-free. From time to time, the Service may be inaccessible or limited due to maintenance, upgrades, network failures, or other reasons. You acknowledge that interruptions or performance issues may occur.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. This includes adding or removing features, changing the AI models or software used, or ceasing operation of the Service entirely. We may also impose usage limits (for example, a cap on the number of analyses per day) or other restrictions as needed. We will provide reasonable notice of major changes when possible (e.g. posting an announcement or emailing users), but there may be occasions (such as urgent security fixes or emergency downtime) where advance notice is not feasible.

You agree that we are not liable for any modification, suspension, or termination of the Service, or for any resulting loss of access or data. If you have paid for tokens and a significant change negatively affects you, please contact us – we will review concerns on a case-by-case basis (for example, if we discontinue a feature you paid tokens for without providing the service, we may consider token refunds).

14. Account Termination and Deletion

Termination by Us

We reserve the right to suspend or terminate your account at any time, with or without notice, if you violate these Terms, engage in fraudulent or illegal activities, or otherwise use the Service in a manner that we deem harmful to us or others. We shall not be liable to you or any third party for account termination or access removal under such circumstances. In serious cases (e.g. fraud, abuse), we may also take legal action or cooperate with law enforcement.

Termination by You (Account Deletion)

You may delete your account at any time by using the account settings on our website or by contacting customer support. Deleting your account will deactivate your access to the Service and remove your profile information from our live systems. Some content you provided (such as resumes or documents) may no longer be accessible after deletion, so please ensure you have saved any information you need before deleting your account.

Data Retention on Deletion

When you delete your account, we will mark your account for closure. After closure, we may retain certain personal information for a limited period to fulfill legal obligations or legitimate business needs. For example, we may retain payment transaction records and invoices for the period required by tax laws (e.g., 5 years), or keep records of your communications with us to handle any disputes. Your data will be archived in secure storage during this retention period and will not be actively used except for the required purposes. After the retention period expires, or sooner if we determine we no longer need the data, we will delete or anonymize the information to the extent feasible.

Tokens on Termination

If your account is terminated by us for cause or deleted by you, any unused tokens in your account will be forfeited and not refundable, except where required by law. For instance, if you exercise a valid consumer right to a refund prior to account deletion, we will honor that; otherwise, remaining credits are void upon account closure.

15. Indemnification

You agree to indemnify, defend, and hold harmless PG Gaming Ltd. (and its officers, directors, employees, and agents) from any claim, demand, lawsuit, or other proceeding brought by a third party, and any related losses, damages, or expenses (including reasonable legal fees), that arise out of: (a) your breach of these Terms; (b) your violation of any applicable law or regulation; or (c) your use of the Service in violation of someone else's rights (including intellectual property or privacy rights). We reserve the right to assume the defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defenses. This indemnity obligation will survive the termination of your account or these Terms.

16. Changes to these Terms

We may update or modify these Terms from time to time, for example to reflect changes in our services, changes in law, or improvements in our business practices. When we make material changes, we will notify users by email or by posting a prominent notice on our website. The "Last Updated" date at the top of this document will be revised accordingly.

Your continued use of the Service after updated Terms are posted constitutes your acceptance of the changes. If you do not agree to a change in the Terms, you should stop using the Service and may delete your account. We encourage you to review the Terms periodically to ensure you understand the current rules for using our Service.

17. Dispute Resolution

Contact Us First

If you have any concerns or disputes about the Service or these Terms, we encourage you to contact our customer support to seek a resolution informally. Many issues can be resolved quickly through our support team.

Negotiation and Mediation

In the event of a dispute, you and ResumeCoach agree to attempt in good faith to negotiate a resolution for at least 30 days before pursuing formal legal action. If we cannot resolve the dispute through direct communication, we may discuss alternative dispute resolution methods such as mediation. (This does not waive or replace any mandatory legal procedures; it is an effort to resolve issues efficiently and amicably.)

Proceeding to Litigation

If a dispute cannot be resolved informally, you or we may pursue legal action in accordance with Section 18 (Governing Law and Jurisdiction) below.

Please note that while we hope to resolve any disagreements in a cooperative manner, nothing in this section prevents either party from seeking immediate injunctive relief or other interim remedies in appropriate cases (e.g. to prevent misuse of intellectual property or confidential information).

18. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales, United Kingdom, without regard to its conflict of law principles. This governing law will apply to any dispute or claim arising out of or related to the Terms or your use of the Service.

For any disputes that proceed to court, the courts located in England and Wales shall have exclusive jurisdiction. However, if you are a consumer habitually resident in a member state of the European Union, you may also have the right to bring proceedings in your country of residence. In such cases, nothing in these Terms will deprive you of the protection of the mandatory laws of your country of residence; you will retain any rights provided to you by consumer protection laws in your home jurisdiction.

19. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a competent authority, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed (removed) from these Terms. In either case, the remaining provisions of these Terms will remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
